Parliament Is Just One Of The Creatures Of Constitution

Parliament it is not supreme. Constitution is. Parliament may frame a law, but it will be always subservient to Constitution. All amendments to constitution and every law made has to pass the litmus test of the Constitution and whether it is as per constitution or not is to be decided by the Supreme Court, another creature of the Constitution. So everything is back to constitution and no one absolutely no one can take away the rights enshrined in it.

 

Supreme Court recently has restored our faith in the constitution in a case which was a direct conflict between the legislature and the Judiciary and which related to the appointments of the judges in High Court and the Supreme Court. In the NJAC case SC decided that the autonomy of appointments in judiciary was part of the basic structure of the constitution, which cannot be changed.

 

There have been several cases where the Government of the day wanted to change the fundamental rights of the people guaranteed in the Constitution. No government may easily be able to change the basic structure of the constitution so beautifully enshrined in the constitution, which we, the people of India, have given to ourselves.
